Almanya’da NSU (Nasyonal Sosyalist Yeraltı ) örgütü cinayetlerinin görüleceği 17 Nisan davası başlamadan komediye dönüştü.
2000-2007 tarihleri arasında 8’i Türkiye kökenli, 1’i Yunan ve diğeri de Alman olmak üzere 10 kişinin ölümünden sorumlu tutulan Nazi yanlısı faşist NSU davası, 17 Nisan’da, Münih Eyalet Mahkemesi‘nde başlayacaktır.
Bu davada bütün dünyanın gözü Almanya’nın üzerinde olacaktır.
Dünya kamuoyunun uzun zamandır dikkatle takip ettiği Almanya‘daki NSU davasında skandal bir gelişme yaşandı. Münih Eyalet Yüksek Mahkemesi‘nin kararıyla davayı izleyecek basın mensupları için „ eşitlik ilkesi“ gözardı edilerek tarihi ve önemli bir davanın tarafsızlığına da henüz başlamadan gölge düştü. Göçmen medya için sabit yer uygulaması gözardı edildi.
17 Nisan’da başlayacak NSU davasında ” yabancı kökenli” hiçbir gazeteci ve basın mensubu salonunda yer almayacak. Akreditasyonu kabul edilenler arasında uluslararası ve dünya basın kuruluşlarından herhangi bir temsilcinin olmaması, ciddi kuşkuların doğmasına yol açmaktadır.
Bu anti-demokratik ve ayrımcı tutuma yönelik tepkilerin artması üzerine, Bavyera Anayasa ve Münih Eyalet Yüksek Mahkemesi Başkanı Karl Huber, „davanın izlenmesi için onaylanan 50 kişilik gazeteci listesinin kesinlikle değişmeyeceğini belirterek bu ayrımcı, hukuk dışı uygulamayı savunmuştur.
Almanya’nın yargı güvenirliğine gölge düşüren bu karar derhal geri alınmalıdır. Tersi durumda Almanya, büyük bir hukuki skandala imza atmış olacaktır. Ve bu da ırkçılıkla hesaplaşma noktasında Almanya’nın güvenirliğini tartışma konusu yapacaktır.
Geçmişte göçmen kökenli örgütlerin yasaklanması konusunda tereddüt etmeyen Federal İçişleri Bakanlığı ve Alman Yargısı, bugün NPD gibi diğer yabancı düşmanı, ırkçı-faşist parti ve örgütleri yasaklamada „demokrasi „ adına tereddüt etmektedir.
Avrupa’da yaşayan Sürgünler olarak NSU davasının takipçisi olacağız. Ülkesini hangi gerekçeyle olursa olsun terketmek zorunda kalan göçmenlerin sürgünlük koşullarında yaşadıkları zorluklara karşı sessiz kalmayacağız.
Münih Eyalet Yüksek Mahkemesi’nin Göçmen Medya’ya karşı uyguladğı ayrımcı ve anti-demokratik uygulamayı şiddetle kınadığımızı açıklıyoruz.
Bu anti – demokratik kararı, Solingen ve Mölln katliamlarının yaşandığı bir ülkenin Yargısı için yüz karası olarak değerlendiriyoruz.
Dünya kamuoyunun dikkatle izlediği önemli bir ırkçılık ve insanlık suçu davasını basit bir formalite uygulaması olarak açıklayarak mağdurların sesi olacak Göçmen Medyasını mahkeme dışında bırakmak, ırkçı canilere güç verecek ve mahkemenin tarafsızlığına gölge düşürecektir.
Zaman geç olmadan bu yanlış karardan vazgeçilmelidir.

-Göçmen Medyanın içeri alınmadığı bir Mahkemenin tarafsızlığı tartışılmalıdır.
-Alman Medyası sesimize kulak vererek Göçmen Medyanın alınmadığı bir salonda yer almamalı ve Mahkemeyi protesto etmelidir.

Die deutschen Medien sollten auf die Gerichtsverhandlung gegen den NSU in München Sensibel reagieren
Die Gerichtsverhandlung am 17 April gegen den NSU (Nationalsozialistische Untergrund) und dessen Morde entwickelt sich zunehmend zu einer irrwitzigen Komödie.
Am 17. April wird die Gerichtsverhandlung gegen den faschistischen NSU beim Landgericht in München eröffnet. Den Angeklagten werden 10 Morde und Bombenanschläge vorgeworfen. Bei den Morden zwischen 2000-2007 kamen 8 türkischstämmige Geschäftsleuten,1 Grieche und eine deutsche Polizistin ums Leben.
Diese Verhandlung wird von Medien aus der ganzen Welt beobachtet. Dabei passierte eine skandalöse Panne bevor, die Verhandlung überhaupt anfing. Es wurden Pressevertreter aus der Verhandlung ausgeschlossen, sodass diese historische und wichtige Verhandlung, schon bevor es losging, mit dieser unglaublichen Entwicklung verschattet wurde.
An dieser Verhandlung am 17.April werden keine ausländische Journalisten und Pressevertreter teilnehmen können. Dass bei der Akkreditierung keine ausländische Journalisten und Pressevertreter berücksichtigt wurden, ruft ernsthafte Zweifel an der Glaubwürdigkeit der deutschen Justiz hervor!
Präsident sowohl des Oberlandesgerichts München als auch des Bayerischen Verfassungsgerichtshofs. Karl Huber, sah sich gezwungen eine Erklärung abzugeben, nach den lautstarken Reaktionen gegen die antidemokratischen und diskriminernden Behandlung der internationalen Presse zu vernehmen waren, in dem er sagte, dass die Liste der 50 teilnehmenden Pressevertretern mit Sicherheit nicht zu ändern ist.
Das Landgericht München muss seine Haltung in der Akkredition über internationale Presse nochmals überprüfen, um die Glaubwürdigkeit des deutschen Rechtsstaates nicht in Verruf zu bringen. Ansonsten wird das Gericht als der Architekt eines schwerwiegenden Justizfehlers und -skandals in die Geschichte eingehen.
Das Bundesministerium des Inneren und die deutsche Justiz haben in der Vergangenheit überhaupt nicht gezögert, um Migratenorganisationen zu verbieten. Heute haben sie angeblich
aus Gründen des Demokratieverständnisses Schwierigkeiten die faschistischen und rassistischen Organisationen wie die NPD zu verbieten
Wir als in Europa lebenden Exilanten werden die Verhandlung gegen den NSU mit Aufmerksamkeit verfolgen. Über die Probleme, der Migranten, die aus welchen Gründen auch immer in Europa leben müssen, werden wir nicht schweigen
Wir protestieren aufs Schärfste gegen die diskriminierenden und antidemokratische Anwendung des Akkreditierungspraxis gegen die Migrantenpresse des Oberlandesgerichts in München,
Wir bewerten diese antidemokratische Entscheidung als Folge einer Politik, die die Massaker in Solingen und Mölln hervorgebracht hat.
Wir denken, dass dieses Verfahren über eine rassistisch- und menschenverachtend motivierten Massaker mit einer Formalität in Verruf zu bringen, obwohl alle Augen der Welt darauf gerichtet sind, den Mördern in die Hände spielen und diese in ihren Aktivitäten verstärken und die Unabhängigkeit des Gerichts in frage stellen wird.
Wir fordern diese Entscheidung des Gerichts für nichtig zu erklären, bevor es zu spät ist.
-Es müssen feste Plätze für Migrantenpresse bei der Verhandlung am 17.April geben
-Wir fordern die Amnestie international (ai), die Deutsche Journalistinnen- und Journalisten-Union (dju), die betreffenden Minister und Parteivorsitzenden und Menschenrechtsorganisationen auf, sensibel auf die Geschehnisse zu reagieren
-Die Entscheidung, keine ausländischen Journalisten an dem Verfahren zu beteiligen muss aus der Sicht der Unabhängigkeit diskutiert werden

PROCES DE MUNICH : NON A LA DISCRIMINATION
Le procès de l’assassinat e dix personnes dont 8 turcs, 1 grec et 1 allemand par l’organisation fasciste NSU débutera le 17 avril prochain à Munich.
Ce procès attrera tous les regards des pays étrangers sur l’Allemagne.
Le Tribunal de Munich vient, au mépris du principe d’égalité, de prendre une décision historique excluant la possibilité pour la presse d’origine étrangère d’être présente dans la salle et de pouvoir suivre le procès.
Aucun membre de la presse internationale ne figure parmi les journalistes accrédités et cela jette une suspicion sur l’impartialité de la justice allemande.
A la suite de cette décision et face aux critiques et protestations, le Président du Tribunal de Munich a déclaré que la liste de 50 journalistes accrédités ne subirait aucune modification. Il a ainsi confirmé cette politique discriminatoire à l’égard de la presse étrangère.
Cette décision qui jette un discrédit sur la justice allemande doit immédiatement être retirée. A défaut, l’Allemagne participera à un scandale judiciaire.
La justice allemande et le Ministère Fédéral d’Intérieur, qui n’hésitaient pas, dans le passé, interdire les organisations d’origine immigrée, ont du mal, au nom de la démocratie, à interdire les organisations racistes et fascistes notamment le NPD.
Nous suivrons, en tant qu’exilés d’Europe, attentivement ce procès.
Nous ne resterons pas sans voix face aux difficultés rencontrées par les immigrés qui ont dû quitter leur pays d’origine.
Nous déplorons la décision discriminatoire prise par le Tribunal de Munich à l’égard des médias d’origine étrangère.
Cette décision anti- démocratique est une honte pour la justice d’un pays qui a vécu les meurtres de Solingen et de Moll.
Cette décision qui laisse, au nom d’une soi-disant simple formalité, la voix des immigrés en dehors des prétoires, renforcera les idéologies racistes et portera une atteinte à l’impartialité de la justice allemande.
Cette décision doit être retirée sans tarder.

Nous appelons la fédération internationale des droits de l’homme, le Syndicat des journalistes, le ministère de l’immigration et toutes les organisations démocratiques à être attentifs et sensibles face à ce procès ;

L’impartialité d’un Tribunal qui refuse la présence de la presse étrangère doit être débattue ;

La presse allemande doit protester contre cette décision en refusant d’y assister.
The 17th of April court proceedings regarding the murders committed by the National Socialist Underground (NSU) organisation in Germany have already turned into a farce.
The NSU Case which will try the pro Nazi fascist NSU who are considered to be responsible for the deaths of a 10 people between the years 2000-2007, (8 originating from Turkey, 1 Greek and 1 German), will commence on the 17th of April at the Regional Court of Munich.
Across the world, all eyes will be on Germany throughout this case.
A scandalous development however was experienced during this NSU case in Germany so closely monitored by world press. A clear breach of the ‘equality principle` occurred with the decision of the Munich Regional High Court which has casted a shadow on the impartiality of such a significant and historic trial.
The press of migrant media institutions have been denied an observation position in the court. No journalist or press officer of ‘foreign origin` will be able to observe the case in court during the NSU trial which will commence on the 17th of April. The fact that not a single representative from international or world press organisations stands among those that have maintained accreditation has lead to serious doubts regarding the impartiality of the trial.
With increased reaction to the anti democratic and discriminatory attitude the president of the Bayvera Constitution and Munich Regional High Court Karl Huber has expressed that the approved list that consists of 50 Journalists who will be able to observe the case is definite and will not change, thus he has defended this discriminatory and unlawful practice.
This decision which has cast a shadow on the credibility of the German Judicial System must be immediately revoked. Otherwise Germany will become signatory to a great legal scandal. In addition, it will lead to great debate on the issue of the credibility of Germany in its struggle against racism.
Today, the German Federal Ministry of Internal Affairs or German Justice system which in the past did not hesitate to ban the functioning of migrant organisations is demonstrating great reluctance to ban racist, fascist and xenophobic parties and organisations like the NPD under the name of ‘democracy‘.
As exiles living in Europe we will follow the NSU trial very closely. We will not remain silent in the face of hardships experienced by migrants that have had to leave there country for any reason whatsoever.
We hereby announce that we strongly condemn the discriminatory and anti democratic decision of the Munich Regional High Court against migrant media.
We evaluate this anti democratic decision as a disgrace to the judicial system of a country that has witnessed the massacres of Solingen and Mölln.
The discard of this decision as a simple formality, and the exclusion of migrant media which functions as the voice of victims from the trial of a case against humanity followed by world media will only operate to strengthen racist barbarians and threaten the impartiality of the court.
This wrong decision must be abandoned without delay.
-Media of migrant press organisations must be given a position to observe the 17th of April Munich NSU trial.
– We invite Amnesty International (ai), the German Press Association (dju) and the minister responsible for Immigration and Harmony, all Democratic Party leaders, representatives and human rights organisations to approach this issue with sensitivity.
– The impartiality of a Court which excludes migrant press organisations is debatable.

German press should listen to our voices and refuse to take place in a court room where migrant press is refused and thus should protest the court.
